can an employer utilize an independent contractor who is already an employee?

We would like to offer an employee the opportunity to paint the office on the weekend, they are salaried and this is not the job they were hired to do. Do we need to pay them through payroll or can we 1099 them?
To clarify, we would pay them a flat rate for the project that's not related to their current compensation. 1099 only means that we do not pay payroll taxes on the income and it's their responsibility to claim that as additional income.

Yes you care allowed to do this so long as you utilize a 1099.

I am an Indian and so do not ustand 1099. But logically speaking, you are offering your employees the chance to earn extra wages. You are asking for work beyond their job responsibilities. Which you should pay for adequately. Even though they are on company rolls, they are not obliged to do this,if not for some kind of compensation.
