Is it Ilegal for a company to Withhold your weekly payroll check?

The reason they are withholding these checks are because you have to take a 35 minute test, But the managers dont tell you ahead of time... When you go in and pick up your check they tell you that you need to take the test before they give you your check, I would like to know if this procedure is illegal. Thanks!

Contact your local Department of Labor. They can and will give you specific information. To my knowledge this is an illegal practice, you have already earned that money and they owe you payment for your work.

no this is not legal. the only time you can with hold money is if it is court ordered, or if you sign a document saying that it is ok for the co. to whith hold money. try calling your work force and labor dep. for your state. they will be able to explain your rights under your state law. and help you get your money. I would ask your employer for the number for the labor dep. or ask for a corprate ph. # so you can varify that they condone holding your check.

Contact the Board of Labor in your state to file a complaint immediately! They will intervene on you behalf.

no. quite genius if you ask me! you take the test....or you dont get your check. im sure they will have more knowledgeable employees after pulling this one.....because who doesnt want their check!?

Is the test optional or required? The test itself could be illegal. If they are paying you for taking the test then, yes, they could keep your check until the end of your shift. If they refuse to give the check at the end of payday, then, yes they are breaking the law. I think it is some kind of participation thing that the company is trying to promote. I think that could be a harassful work enviornment. You may want to consult an attorney. If the test is to be used for placement, promotion, demotion, job class, or other some such reason then you may have a labor law case. If it is for informational purposes only, then you may not have a case.
