How many full time hours do you need to work to automatically and legally be full time?
Asked by riotgrrrlbomb
I'm currently work part time at my job, but have been working full time for a number of months...I was told that after a certain number of weeks your employer automatically and legalally has to make you full time, I just wanted to know how many weeks that is, or how I can find that info out because our human resources doesn't give that information.

depends on the state laws--usually after 32 hours a week is what i was familiar with when i worked---I'm retired now--if you are not getting that you might be eligible for ---under employment---but some times a greedy employer will work you that way to get from paying certain fringe benefits--and then they might place you on salary----meaning by some state laws they can work you up to 48 hours a week and pay you straight time---

Your employer can keep you part time as long as they like but the day you you hit 40 hrs in a five day work week you are full time.

This can't be answered correctly without more information because it will vary from state to state and company to company. In my hospital setting, we have "per diem" employees who work "when needed" and their hours can vary widely -- from 8 hours in one week to 50 hours in one week -- depending on need. They are not benefited and not considered full-time employees. In our company, you are full time if you are *regularly scheduled* to work 32 or more hours per week. If however, we continue to use these per diem employees *consistently* in a full-time capacity, then we would ethically (but not legally, mind you) need to change their status to full-time, with all the benefits that all other full-timers receive.
