What are my rights as a waitress?? Can my restaurant make the waitresses share tips?
Asked by cmyers1849
I have a couple of questions. Number 1: I work in a small restaurant in a college town. On the weekends we have a busboy (who gets paid $7 an hour), my boss wants us to start tipping him. Busboys work hard, but we are a small restaurant and on busy nights I might make 80 bucks..and I do everything he does (bus and clean table, bring dishes to the back, etc) does she have the right to make us tip him?? (extra info: she says she is doing this because he wants a raise)
Number 2: She also says she is going to start making the wait staff share tips. Is this legal? Some of us work harder than the others and I don't think that would be fair.
I have worked in larger restaurants where we have had to tip out to everyone who has helped us, and I understand that and I am all for that. But, this is a small town, some nights we might leave with as much 30 bucks, which is what he is gonna make with his $7 salary.
I've been at the establishment for three years and its hard to "teach an old dog new tricks". She is also a very underhanded boss (she once wanted me to run off a mouthy waitress), so this is why I'm fighting the new rule at work, not because I don't think he deserves it.

It is very legal and it is the policy of most restaurants to do some sort of tip share. Usually a server would share with the bussers, the hostess and the bartenders. If you don't like it, then you should quit. No use staying there and always being upset. I waited tables once where I had to give up 3% of my total sales for the night. Imagine if I had a night of no tips at all, I'd be in the hole. Find a place with better tips and you won't mind as much.

Yes everyone is part of the team even the diswashers. Without their support you would not make as much. Most resturants do require that the waiters share tips.
If you do not like it then quit.
