chris
what are the laws concerning verbal contracts in texas. i am a carpenter.?
Asked by chris
i entered a verbal contract to install trim in a new home. after about 80 percent was complete i had to pull off the job due to builder problems. i was to return in 2 weeks to complete and the builder kept pushing the date forward for other problems. i asked for a draw and it took weeks to receive it . after he said it was in the mail. this was the 3rd job for this builder and always the same problems. so i told him i was not going to finish the job and we were even since he gave me a draw for the work completed. now he is saying he is suing me, and coming after me for luiquidated assets. WHAT DO I DO.... THANKS FOR YOUR INFO

IGNORE HIM! www.findlaw.com (everything u need is here 4 free) as for him suing you, no! A word of advice from a contractor's wife also in TEXAS (DFW), if your not getting a drw EVERY week to pay yourself and crew, WALK AWAY! You also knew this builder had "Issues", NEVER do multiple jobs for someone when you've already had problems! Dude, there is SOOOOOOOOOOOO much work here in Texas we've been from austin to dfw and always found work everywhere! Just change your number, also get the word out to local contractors about this a*sHOLE!

if you gave your word, you don't ever go back on that no matter how much of a worm the builder is. Verbal contracts ARE legally binding in the state of texas but your case would be determined by a court of law. the builder would need to provide reasonable proof such an agreement was made though. and since you just admitted it was, i would say he can probably do that. i would likely have just returned and finished the job, since it was only 20% remaining, and then discontinued the business relationship. he is probably only bluffing about taking you to court- how much would he stand to gain?
