My 19 year old daughter is not getting paid for waitress/cooking at a new small restaurant?

Can anyone give advice how to take action? Owner is ripping off all workers and not paying suppliers etc. My daughter just gets the run around when pay day comes. She is scheduled 17 hours many days and I am sure owner is not paying payroll taxes etc. Generally a crook, how can action be taken?

Contact your state's Department of Labor, Wage and Hour Division. They will investigate and they can offer advice as to your options. Second, contact the IRS. If he is really not remitting payroll taxes and withholdings, they will come after him. A bonus to this option is that the IRS pays a 'finders fee' based on the amount of back taxes collected to the reporting person. There are lots of waitressing jobs. Leave this place. There's no sense in working for free when an honest employer will pay for honest work.

Call the department of labour as what was suggested earlier by someone. Also in the mean time help her look around for a new job. This is America the land of oppurtunity I 'm sure she will find something great with persistance. Good Luck to her!!

You need to talk to the owner yourself and find out what is going on straight from the horse's mouth. Do not threaten him, even with legal action, it will only make him angry and you don't want to put your daughter at risk for a hostile work environment. Make sure your daughter documents EVERYTHING. Her work days/hours and anything the owner says to her or she overhears him telling others. If he is still ripping her and others off, go to the police and tell them what is going on, because tax evasion is a crime. Let the police be the ones to investigate and to tell you how you should proceed with the matter. They may suggest that you file suit in small claims court. Good luck.

Tell your daughter to stop working at that restaurant for a couple of days. The owner will start to wonder why she isn't working, and he will have to pay her if he wants to keep her there. Otherwise, she should start working at McDonalds. Anyone should be able to get a job at McDonalds. I've seen some of the kids working during the evenings at McDonalds. They don't look like they hate their jobs. McDonalds should be a good place to work.

Without a doubt, like others have stated, call the labor board immediately. They will be out there in no time. Also check with social security to see how much has been paid into your daughters account. If nothing, then the restaurant is not paying into SS. Report them to SS also if this is the case. Your daughters account will be credited, as long as you show proof, and they will be all over that restaurant.
