can a emploer fire a guy if they receive an anonymous report that he was convicted of residential burglary?

the position he holds is a forklift driver. and his offense was 9 yrs ago. on his application not sure if he reported it or not? are they likely to fire him. the job is in a factory producing plastics.

Yes if he lied on his application. His best bet would be to go to his employer & say that he thinks he made a mistake on his app. & explain it to his boss.

If he lied on his application it might be taken as proof of dishonesty, but most job applications say , within 5 years .
If he is an at will employee he can be fired without a reason given.

This depends on the company that he works for. Every company has different policies and if there policy is that they do not hire someone with a criminal background then they can fire him. Some companies have policies due to safety issues. Like If it is a business that deal with Children and they find out this person had a sexual offense in his past against a child by all means they can fire that person.
Sometimes it doesn't matter how long ago a crime has been committed if the company feels that it is against their policy or that this person may cause harm to the company. employees , or clients then they have every right to fire them. they could also fire someone because of security reasons. It all depends on the company.

This depends on a few things:
1) The company cannot terminate an employee on the basis of hearsay. They must be able to offer proof that the employee has a felony conviction (not just an arrest) about which s/he lied on his/her application.
2) If the company conducts background checks at the time of hire, getting this proof is pretty easy. If they don't, and they want to check someone's background once they are already employed, they would need to obtain the employee's consent to investigate his/her background. There are many companies who will conduct a background check for a small fee ($25 - $40 is typical.)
3) if they do run a background check and find a conviction, then, yes, the employee can be terminated for falsifying the employment application.

sounds like this guy is really your enemy,read your other ques.about him.i have worked with people like him and they are very conniving.they usually dig their own graves.just try to concentrate on your own position/duties.he'll hang himself.
i know it's hard but he's not your problem.it's really useless to write an anonymous letter,the employer will wonder why couldn't you sign your name.then,start looking at everyone trying to figure it out.so,either say it or not!
