Is it legal for collection agencies to call and harass you?

I have this one collection agency calling me and my parents house harassing us and giving us major attitude. She continuously threatens us with being served and saying I will either be arrested or kicked out of school? Is it legal for them to do this and what can I do to make them stop?

Also you will have to get an attorney to represent you. Although creditor's have rights, debtors usually have more rights. The site I gave you is the Fair Debt Collections Practices Act and it outlines the rules that collection agencies must follow. If you feel that they have violated any of these laws please seek legal help.

If you owe money but cannot pay the full amount pay a dollar or two because then legally they cannot call you because you are making an effort. Then if they take you to court you can show the judge you were paying for what you could afford. From my experience the judge drops the bill and the company gets screwed! Good luck.

No...that's illegal..i used to work for a collection agency..tell them you know the FDCPA (Fair Dept Collection Practices Act) and you will sue them if they call you again. That will get them to stop harrassing you or calling you all together.

It is not legal to harass. Somebody told me that all those calls are taped and if you confront them and say you consider their actions harrassment they cannot call back anymore. It worked for me when I had a similar problem with a medical bill in collection.

I agree with the other posters, what you describe would be harrassment. They are allowed to call during certain hours( here it is 8am to 9pm) And they can say you owe the bill and how to pay it. They can also turn it over to the courts for wage garnishment.

find out the name and address of the collection agency then send a letter certified stating all communications from now on must be only in writing, after the receive the letter they can call one last time to confirm the letter, then if they call again report them to the state attorney general office
