Do you need a lawyer to have a legitimate Power of Attorney assigned?
Asked by cnrplus4
I need to become someones Power of Attorney to help with the finances while they are ill and I can not afford a lawyer. Can't I just go get the paper work from an Office Max or Office Depot and then have it notorized?

Yes you can go to a Notary and authorize documentation, but when it's a situation with someone being ill and a Power of Attorney is given, most legal realms would not honor it as valid or legitimate because it was not prepared before an Attorney and/or by an Attorney because they look at the illness of a person as if they are not aware of what they are signing and they may be influenced to sign. Othewise, why didn't they go to an Attorney in the first place. It's always best to cover yourself and the individual if it's someone you care about so that all the T's are crossed and the I's. You can definately get a Notary to sign, but both parties are to be there in witness of the Power of Attorney if you are therefore using a Notary Public instead of an Attorney. Attorneys are also Notary Public naturally once barred, but to get a Power of Attorney done by a realtime attorney is not that expensive. I have no idea how old you are, but I'm sure you can afford it because it's not really that expensive considering the type of documentation it is. But to answer, yes you can do this.
Good Luck!
