Can a company file cases against those employees who applied to other companies but are not yet cleared from the previous one. This is for the Philippine setting. If possible, please site some legal laws or labor law sections. Thanks! Can a company file cases against those employees who applied to other companies but are not yet cleared from the previous one. This is for the Philippine setting. If possible, please site some legal laws or labor law sections. Thanks! Im sorry for the confusion... The situation is that they are already employed in another company. What if they have liabilities from their previous employer which is not yet cleared and they are on AWOL? Can any legal case arise?

According to your question, the employees have only APPLIED for jobs, and have not quit the services of the present organizations where they are serving . The question of settlement of dues from th company or liabilities of the employees arise only when they quit the services of the company. Hence the question of taking any action, what so ever, in the circumstances mentioned by you, does not, therefore, arise !!
