Can your employer use your picture on a newsletter it sends to customers?

The company is an online retailer. They want to take a group photo of the employees and send it out to our customers through a news letter. If the employee chooses to not be in their picture do they have a right to force that employee?

You may have signed away certain rights, including the right for the company to use your photo, likeness, or words in documents which represent the company, when you were hired. Check your company policies or check with HR. Most companies won't force an employee to be in a photograph - nothing spoils a group photo like 40 happy faces and one person with their hand in front of their face. :)

Yes they can. You work for them, you belong to them!

It depends largely on your terms of employment; it is likely you have a contractual obligation to participate in PR activity as long as it's reasonable. If having the photo taken could even be loosely construed as being related to your job and there's nothing in the photo and/or associated article to identify you outside of work then you have little legal grounds to object. You could ask them anyway - it's quite possible they'll exclude you simply out of courtesy.

No they can not force you tp have a picture taken. They can ask you. If you don't want to do this tell them and let them know why.
