Will I be able to collect unemployment?
Asked by snypavat
I have been employed for 2 years as a CNC machinist. Recently I was given a written warning for screwing up a job. It was a difficult job to complete. A few weeks later I was given the job again, and screwed it up again. I am worried that since business is slow they will fire me. I tried my best at completing the assignment correctly but I could not. I am worried that since I recieved the written verbal warning I will be fired and not be able to collect. I have been looking for a new job but if I am fired and cannot collect than I will be homeless fast. My wife has become extremely sick for months and she is not working and is still waiting for temporary disability insurance. I am VERY worried at this point and I am not sure what to do.

The chances are that you will be able to draw unemployment. I was fired from a job a year ago after I was given a written warning. In my case, the training provided to me was inadequate and I was not allowed to ask questions. The day I was fired, I was told by HR that I will be able to collect unemployment based on the fact that I did not meet the company expectations. Fortunately, I found another job within two weeks as a plant manager. While I was devastated at being fired, in retrospect, I look at that experience as a training ground of how NOT to be a manager. I make sure my employees have all the training they need AND let them know that they can ask all the questions they want. On the flip side, a month after I got the new job, I had to terminate an employee. She was given a written warning and a verbal warning. She intentionally screwed up her work knowing that it would reflect on me as plant manager....long story...but, ultimately, she applied for unemployment and was initially denied. She took it to court and eventually won based on a lot of lies. The court system really does tend to side with the employee in these cases. So, I wouldn't worry too much. And... FYI, it sounds as if you were terminated, it would be based on not performing your job as directed. I don't know about other states, but here in Minnesota, that is not grounds for withholding unemployment benefits. Keep your options open and if another job opportunity comes up, then go for it. Even though I am very happy with my present position, I still keep my options open. One never knows what might happen! Also... just a heads up on your wife's situation... disability insurance is very, very difficult to get, so please don't plan on this as an income. If she gets it, great! If not, don't give up fighting for it. I have a relative that eventually had to hire a lawyer to get her benefits, but it paid off. Good Luck.

Honestly, if you're fired following three write ups you probably won't be able to collect unemployment for at least six weeks. Calm down. Get a grip. Talk to your supervisor and explain you're under stress with your wife's illness and that you will really work hard to improve.

If they fire ya, you can collect. If you quit, you can't. I don't know the law in your state but most states follow the normal fire/quit policy.

I agree with everyone else. Try to look for other jobs first, before you start worrying about everything else. There are always ways to get around things, so that you can collect unemployment. But unemployment is a LAST RESORT. Dont focus on that until you have to. But you'd most likely be able to get it. You'd just have to tell them that the job they gave you to do was not expained thoroughly and they didn't give you the proper amount of training.

Do your best until "it" happens because when and if it does it will be nearly impossible for you to collect. By them already giving you warnings it shows you are getting the job done and they have every reason to get someone in there that will. Keep looking without making it obvious and good luck.
