Can an employeer fire you for having a second job?
Asked by shaguar47
My girlfriend is in a pickle right now and currently has two jobs. Her main job is a cashier but her second is landscaping. Truthfully, the landscaping job pays alot more but the cashier position she's had for a very long time! Her employeer just found out that she's working at a second job (landscaping) and is threatening to fire her. Can they do this? What can she say to them about it? Sounds to me like the employeer is acting jealous!

If she really wants to keep the cashiering job I'd suggest she tell her boss(es) there that she quit her other job and keep it a (more closely guarded) secret that she's working there.

It all depends what her main job's policy is. She needs to see the manual/policy and what it says about 2nd or supplemental jobs. If there is no policy on it..then she can do what she wants as long as it doesn' t interfere with her work in her main job.

sometimes a company can not hire you if you currently work for a competitive business...say a costco and a BJ's but with two totally diff jobs they should not be able to fire just on those grounds....they could say her work performance or availibility has become undesirable she can either just quit and screw them or if she really feels like she is being taken advantage of she could talk to a lawyer...or your states dept of labor for the real law on it

Most states are "right to work" states which means she can be fired for any reason, including no reason at all, as long as it isn't because of one of the "protected" things like race, gender, religion, etc

While I do not know the legality of terminating her for just working a second job. I do know that a company can and will terminate your employment if a second job represents a conflict of interest. Such as workings a teller where her second company does business. In that situation there could be a conflict of interest.
The company I work for currently makes all employees sign an at will employment document. This document states that both you and the company understand you are working for them at will and can terminate employment any time by either party.
Your girlfriend may need to determine which job is more important to her.

They could let her go if they felt it was interfering with her primary responsibilities (ie, not working OT when requested, etc.).
