In California-is it legal for a company to not give you benefits after being there for 7 months? Fulltime?

Aperson was hired and told after 3 months of probation benefits would kick in. She was hired fulltime -and when she asked the HR department when benefits would kick in -their re4ply was -theres a hiring freeze and she is just a temp hire----which she was NOT told when hired-------and the ad she answered was for a fulltime position-----nowheres was there any mention of temp or other status! This is a big company and during the ending of last year there were a lot firing of employees and layoffs. Do you thinki this is fair and where can I find out if this person is entitled to somekind of benefits as mentioned in their ad?

benefits are set by the employer they are not mandated by law. if she is considered temp and fits their policy description for temp employment then she could not be eligible. as far as "full-time"; labor law does not recognize any such term. whether a position is full-time or part-time is set by the employer and has no basis in law. the law only becomes involved if policy is not being fairly and equally enforced or followed. for assistance contact the states department of labor standards enforcement at: http://www.dir.ca.gov/dlse/DistrictOffices.htm

benefits are just that a gift, employers are not required to give them to you. they can be given and taken away at anytime
