Is it legal to keep one employee at part time and pay another full time?

I have been working full-time hours at my job, but I am "officially" a part-time employee (so basically working the hours with no benefits!). Is this legal? Does there come a point where you can claim full-time status? If my coworker and I are doing the same job and working the same hours is it legal for my employer to consider him full time and pay him benefits and consider my part time and pay me no benefits? Isn't that discrimination?

Unless you have an union, such unethical ( BUT NOT ILLEGAL) practices continue. You can however represent the anomaly to your employer .

Yes it's legal. And there isn't a legal classification of full time - that's whatever the employer chooses it to be. There is no requirement to give benefits

Yes they can do that. My ex-boyfriend was working full time hours at part-time status for FIVE YEARS!!!! They finally put him at full time, but they said it was because he had left the company and then came back, so he was unreliable and now he has proved himself I guess. You should ask the CEO if you can have full time status since you have been filling in hours. Good luck!

Yes, it's legal to have you work and be paid as many hours as the schedule you for. There is no law that says a company is required to provide you with benefits. The airlines do this all the time, and have a large base of employees considered "part-time" but they work anywhere from 20 - 40+ hours a week depending on the work loads and staffing.

Yes it is legal. No employer (in the US) has to offer benefits to full time or part time workers
