Collect unemployment if I quit due to employer's instability, incompetence, & drug use? in NYC?
Asked by jaktripper2000
I work at a recording studio in New York as a technician and my employer is an unstable and erratic individual. Equally as erratic is my workplace...This lack of leadership at the top creates an environment of chaos at times, where no one knows anything (especially my boss...the owner), and we employees are left to clean up his mess.
Also, my employer has blurred my job responsibilities to encompass duties that were never agreed upon (such as general maintenance, personal errands, and any task he decides to give me, job related or not) as well as not living up to a promised raise after one year in this position.
To top it all off, he is a marijuana user and has been under the influence in the work place as well as leaving paraphernalia about the studios.
I am considering quitting because, for my sanity, I simply cannot be in that chaotic environment, under his incompetence any longer.
Do you guys think I have a case to collect unemployment if I quit???
BTW, I meet all basic requirements...ie: hours worked, length of employment, etc.

In determining eligibility for unemployment, first, regardless of the circumstances, you have to have worked a certain number of hours within specified quarters in order to be eligible for unemployment. You should check at the NYS DoL website for specifics (link provided below)
Secondly, you can always apply for benefits. However, the employer can deny the claim, and then you have the chance to appeal. Each case is evaluated individually, and it is a complicated process, so there is no telling how it would go for you. Again, ,the best source of information is the Department of Labor site.

Probaby not eligible for unemployment, but you can apply and see what happens. Of course, by that time, you'lll be jobless so if it gets turned down, and it probably will, you won't have an income. Your better path would be to look for a new job, then quit as soon as you find one.
