Can a company fire me not having a drivers license when the job description never stated it as a requirement?
Asked by abbes
My bosses's approaches me yesterday and said that i cannot work here due to not having a drivers license, just a learner's permit. This was not stated in my offer letter or the job description as a requirement. This is also not stated as a requirement anywhere on the compay's site or on any corporate documentation. Is this legal or can I sue the company for discrimination? What's the law?

Get a lawyer. If it wasn't required to start there then it shouldn't be one to continue working there.

Most places have a no reason clause and they can fire you for no reason at all. So yes they can,

They can do what they like if they do not like you

It depends where you live. Most states are "at will" states which mean they can fire you anytime for any reason. If yours is not an at will state, then you contact a lawyer and at least get an opinion, because they can't fire you for something that wasn't originally required.

well it depends on what your job description is. if you were hired to drive, then obviously you need a drivers license and they can fire you. i could be wrong though..

as far as i know no a corporation or place of employment cannot fire someone for somthing un specified as a requirement at the time the job was given. its like if someone didnt state that age was a factor in the career then they cannot fire you after you were hired for being too old or too young. i think if they hire you with it they have neglected their dutys to inform you of that before the job was given.
but im not a lawyer you might want to speak to one and your boss

Depends on the company.

If your job requires you to drive, i.e. pizza delivery, or part driver, then they can require you to have a full d.l.
If driving has nothing to do with your job then you may have a claim. You can check with the Equal Employment Opportunity commission's regional office. Look at the following map:

The idea is to search out for discrimination in the following:

Keep your chin up, things will work out.

sue for discrimination?
NO.....lack of drivers license is not a protected class
protection from discrimination is provided for
age(over 40)
sex(orientation is not protected under federal law)
religion
national origin
race
disability
can they fire you?
YES......unless you have a contract that states otherwise
almost every state is an "at-will" employment state and many contracts even contain an "at-will" statement. you can be terminated for any or no reason, the reason or "cause" comes into factor when filing for unemployment insurance. if the employer does not have cause to terminate you then you will qualify for unemployment insurance(if you meet the other criteria). if there is harassment that causes a "hostile work environment" it is possible to file a complaint with the department of labor even if a protected class is not involved but that is rare and extremely hard to prove. if discrimination is involved you file those complaints with the EEOC.
