What is the usual termination agreement for wine sales rep?
Asked by freja
If a sales rep is great at selling and manages to win the company many new ongoing customers- wouldn't the sales rep want to protect themselves in case they were replaced after all the HARD work was done? So what payout should it be in case of termination?

You need to negotiate this with your boss. Ask for more than you are hoping for at first so you have room to come down without losing out too much. Work out what is best for you. If you have been with the company a long time you may want to ask that the payout is say 4 weeks pay for every year of service. If you have been there a shorter time it may be best to ask for a set amount - say 16 weeks pay.You may be able to insert a clause which says it is 16 weeks pay until such times as 4 weeks for every year of service exceeds that amount and then it moves to the larger amount. If you are on commisssion as a large proportion of your salary as in mosts sales jobs then you must ensure they average out your wages+commission to calculate the proper pay rate or you will have lost out badly being paid 16 weeks base pay. Once you have negotiated this with your boss make sure it is formalised as part of your employment contract or you could miss out should they decide to let you go and just not honour a verbal agreement.
