Can a server be forced to pay a walked table?
Asked by archfield1
If a tab walks out on a server can the business legally force the server/waiter to pay for the lost check. If details matter, it's in a restaurant where servers carry all money until the end of the night and pay up the amount owed, located in OK. Link me some legal references if possible. Yes over the long run the price of a walked table is minor and it doesn't happen much, but it's partly the principle of it, and I'm still interested in seeing some written law on it.

Depends on the contract that you signed when you were hired. If you agreed that you would be personally responsible for all tabs issued under your shift, then yes - you signed the agreement. If you signed no such agreement, then no you cannot.

That is such a rare situation, and is so insignificant in costs that it probably wouldn't be worth the while of the restaurant to pursue anything on that from the server. They can't just "take money out of the paycheck" w/o a garnishment order or a deductions request from the employee. Any restaurant getting that nit-picky over 20-30 bux or whatever isn't worth working for.
