Graham
will i get Job Seekers Allowance if i'm dismissed?
Asked by Graham
I am a maintenance manager, and need to order parts on a regular basis, however recently i have been under performing (making basic mistakes) and had not noticed it, i've been with my current employer for 11 months. In March i had a assessment that said i was not up to current standards and needed to improve. just before this i needed to order some parts for a machine refit. i did not order the correct parts, they then called me in for a investigation meeting, at the end of which i felt that bad i needed to go home sick and in tears. I then went to my doctors who diagnosed with stress. I had already had a written warning for a separate issue some weeks before. At the time i had been asked if i was under stress by my manager and i being the macho independent type told him i had it under control. It looks like i am making the Stress up to avoid the sack but if you've ever suffered from stress you can understand, and that we all expect stress at work so i tended to ignore the signs, until it gets this bad ( not noticing you are making basic mistakes) I know i am liable for dismissal due to poor quality of work and the fact that i am within my 12 month probationary period. But the question is this:- Due to what i have stated above will i be entitled to Job seekers allowance if i am sacked for misconduct?

UK. No you don't get it for 13 weeks, my son in law was fired from his job back in January, married with 2 kids and was told his wife would have to sign on claim for him and 2 kids and find work, she starts night shift in nursing home next week. They expect you to apply for a crisis loan of about £40pw until you qualify and then when you get £60.50 for a single person they take the loan back at £7 pw

A:
yes i signed on due to dismisal of misconduct for being under the influence of alcohol at wrk and i signed on no problems so you should definetly not

I don't see how they could sack you for misconduct. Making mistakes...even being completely incompetent...isn't misconduct. If you're on a probationary period, and your employer doesn't think you're up to the job, you should get JSA if he puts that as the reason for dismissal on the form they send him.

If you get sacked you can claim JSA the only time you cannot claim JSA is if you walk out from your job. But if was you I would try and back up my ideas and try to get the ordering right even if it means asking for help from someone you wor with Like collegaues managers above you they are there to help you so if you are struggle do not be afraid to ask it will just make you worse of and risk losing your job.

You can't be dismissed when you are off work sick and you can't claim JSA if you have a sick note you would have to claim Incapacity Benefit. But you would be able to claim JSA if you are on IB and then the doctor says you are fit to work. Hope this helps
