Is it illegal to be fired for refusing overtime?
Asked by Adna
I am an underground coal miner and I have to work six days a week almost every week of the month. I work sixty hours a week at sixteen hour shifts almost every day. Is it illegal for them to fire me for refusing to work saturdays if I already worked forty hours?

What is your agreement with the company? All companies I have worked for asked if I would take mandatory overtime, travel, etc. It was a condition of my employment.

A:
employment laws are different in every state - are you part of a union or do you have a employment contract that details your hours to be worked - employers get away with firing people for alot of different reasons - check with an employment law attorney in your area

Mandatory overtime exists. Suck it up. You were fired for cause. Learn from the lesson.

It might be. You have to contact your state's attorney general's office. Also you can now apply for unemployment pay if you got fired.

16 hr shifts would be 96 hrs in a 6 day period - it would be 64 hrs in a 4 day week - yeah, you probably can be fired for refusing to work

It's not illegal for them to fire you for refusing to work overtime. But if you do work overtime they must pay you overtime pay for the extra hours.
