My company I work for have began to do video mystery shopping. Is this legal?
Asked by nickyc26cfc
I knew this was going to take place but signed nothing of any sort. A couple of days ago a DVD was sent out to all of our stores where every stores mystery shop results have been collated in to one disc. I was the person who was tested...Is it legal that I can be filmed like this without signing anything? Well the difference is footage of me has been sent to every other store we own...CCTV footage isn't distributed in this way?

its against the law to record someone with out them knowing , they don't need to ask you but , must put sings up or they can tell you , if ever you did some thing wrong they wouldn't be able to do anything with there evidence simply because there where no sings up the cctv was in Progress ,

Well if your shop has CCTV then you are being recorded anyway, so what is the difference.

Depends on your state/local laws. Usually commercial distribution requires signed consent/waiver contract. If you work for the company that did it. You might want to check any contracts you signed before taking the job.A waiver/consent agreement can be buried in there. You should first ask your employer to remove you from the tape. And then consult a lawyer if necessary. They could say you gave verbal consent or it could be in an employee contract. When I worked in retail it was in the employee contract.
