Is it legal for my company to make me stay at work even though we have no running water or toilet facilities?
Asked by Jamie G
Thames Water have switched off the water supply, which means we have no running water, or toilet facilities (ie no flush to flush peoples poo, urine etc) The company has also not provided us with any port-a-loos. Only bottled water has been supplied. Is it legal for us to still be kept at work??? Many Thanks

Hello. No it NOT legal. The link below will take you the Health & Safety Executive who you should ring right now to find out what your rights actually are. http://www.hse.gov.uk/ I would also discretely contact the Environmental Department of the local authority in which you work. They take a very dim view of this sort of thing. Good luck. Big L 266

A:

no i think that they are breaking the law if you are in a Union I would recommend that you and the other people who work there get in Touch with the union as they know the laws better than anybody else

I would say that it IS NOT legal. YOU SHOULD HAVE TOILET FACILITIES AS WELL AS A WASH BASIN TO USE, IN PRIVATE, WHEN YOU GO TO THE LOO. A FREE STANDING WATER DISPENSER UNDER A SERVICE CONTRACT, WOULD BE AN ALTERNATIVE FOR DRINKING WATER. IF YOU DO NOT HAVE THESE FACILITIES. GET IT IN WRITING THAT YOU CAN TAKE (SUFFICIENT) TIME OFF (WITH PAY) TO GO TO THE NEAREST FACILITY. AT LEAST GET IT SAID BY YOUR EMPLOYER WITH A WITTINESS PRESENT, FOR YOU. DO YOU BELONG TO A UNION? IF SO, LET THEM WORK FOR YOU. YOU CAN ALSO GO TO THE LOCAL COUNCIL, EXPLAIN TO THEM THE PROBLEM AND ASK FOR THE HEALTH AND SAFETY OFFICER TO VISIT THE SITE. YOUR EMPLOYER COULD BE FINED...

Your employer must provide adequate toilet facilities which includes clean toilets as well as hot and cold running water so far as 'is reasonably practicable'. This situation was not caused by your employer and they have done their best to provide water. I don't think this is illegal - unless smells from the toilet start getting into the offices. Is there no large supermarket nearby where you can use the toilet facilities?

It's not forever - bide your time. Just use the pub's next door.

Well it seems that its not the employers fault, its the Thames Water Department that shut off the water to fix an issue. I am sure its not permanent and the employer is trying to work the situation out. If there is a near by facility that you can go and use the toilet facilities then go.
