Is it illegal for a CNA to work privately if their license has lapsed?

My grandfather has a live-in CNA who he hired privately. She was certified as a CNA but now her license has lapsed. Is this legal because she was hired privately or illegal because her licince lapsed? I thought so....thanks everyone. I thought so....thanks everyone. I do know she was hired as a CNA not a PCA. If you are hired as a CNA wouldnt it be illegal to continue employment if your not a CNA anymore?

what you have explained is totally legal to work in a facility (long term or acute care) that accepts Medicare/VA/Insurance the person must be a licensed CNA. to work for a home-health agency that accepts Medicare/VA/Insurance the person must be licensed as at least a HHA. to work for a private individual as a casual employee NO license is required.

She needs to renew her license she's not a legal CNA right now with this lapse license.

It is absolutely illegal to work with a lapsed license. She could perhaps do companion care, but you would be drawing fine lines here which would cause problems. Get someone else.

If your grandpa is hiring her privatly WITHout going through another company, then no it is not illegal... he can privately pay anyone he chooses, even if thier not 'qualified'. (ie:paying her cash/check from his direct account) Also... if a company IS involved (like a middle man) then rules have been set up to wheather he needs a certified CNA, because a PCA sometimes does almost the exact same work and it only takes watching a few movies to be a PCA. Truth is, that she KNOWS or has the direct ability to find out if she is being 'legal'. She should renew her CNA if she is going to continue in the field.
