In Home Health Aide questions...(its a long one)?
Asked by SandraAmore
So this one is a doozy.. I am an in home healthcare aide. I have one client she has cp. There are 4 workers in her household. I have been there the longest. I have been with her since March of 2008. I work for 2 different agencies. a local non profit organization and ihss a state funded program. I only work 3 days a week at 3 hours a shift and an 8 hour weekend shift every other weekend. But we have been instructed by our boss to be using all of my clients hours so they wont get cut. So usually I only work 17 hours a week (with weekend hours) but he tells us to bill for 30 hours a week wether we have worked them or not. And recently stuff has been going missing including money and medications. I also found out recently that one of our new girls was fired from her last job for stealing.. My boss has done absolutely nothng about whats been going on. I do not want to be a part of it anymore but I need my job. He also treats me differently from the girls. and everyone knows it and sees it. He tells me I cant do something but lets other girls do it. Its not a race, age, or gender thing. I dont know what to. He is always rude to me and threats me about losing my job, refuses to give me a raise and acts like I am the most horrible employee and treats me like it. I definately feel I am treated differently. What should I do. Do i have legal rights? If you anything about this please let me know. There is so much more too. PLease let me know asap. thanks so much.

This is illegal. It does not matter whether your boss told you to do it or not -- it's your signature so he can deny, deny, deny. Since you work for a state agency you could also be charged with a crime by the state for falsifying documents and stealing from the state. This is the type of stuff you see in the news -- you do not want your face on the evening news. Document everything illegal that is going on; report it to the licensing board in your state that is in charge of health care; make sure you get some sort of proof that someone in this dept. received your information. File a complaint with the EOC stating that he threatened to fire you if you don't go along with his illegalities. Let the idiot fire you then you can sue (you must have documentation). There is a HUGE demand for home health aides; look around, you should have absolutely no trouble getting another job.

If you continue lying to yourself and denying to yourself what you know is true, you may not only be miserable but become sick. It's amazing the power we have over our own health. I recommend getting information about as many supervisors above this guy as you can and writing a simple paper on each of the most major crimes you have witnessed on his part and/or those of your co-workers. Then file these with copies to as many of those supervisors at the same time so that no single person can cover it up or sweep it under the rug. It wouldn't hurt to find a friend who is a lawyer and willing to advise you for a token retainer of a small amount. And look for the laws in your state that protect whistle blowers on sites such as this one: http://whistleblowerlaws.com/index.php?option=com_content&task=view&id=141&Itemid=54 And fear not - the more control over your surroundings that you exercise the happier you will be...because you'll have peace of mind. And no one can take away your integrity except you.
