My employer wants to transfer me to a county 30 miles away, if I refuse to go can I still receive unemployment?
Asked by Muffin
In 2004, I was hired part-time at my job. In 2008 I was asked to go full-time and work in a nearby county. When I was hired I informed my supervisor at the time that because I am the only caregiver for a disabled parent who lives with me, I am unable to work outside my county. I also reminded the supervisor of this when he asked me to go full-time and he stated he understood and placed me in a full-time position in my county. Now the program I work in is closing and my NEW supervisor has offered me a position in a county 30 miles away. I explained my situation and was told that was the only position available. If I refuse to take the position, can I still collect unemployment? I work in Florida.

30 miles is generally not considered a "significant" change so most likely the answer is NO but with that said your other issue of being a care-giver may (not will but may) be taken into consideration. all you can do is file if you don't take the job. the state can not (will not) render an opinion about eligibility until you file a claim. http://www.floridajobs.org/unemployment/Frequently%20Asked%20Questions.doc EDIT: FMLA is unpaid leave and you can not get unemployment benefits if you are on leave of absence from a job.....

Depending on the size of your co, you maybe covered under FMLA where they would have to accomodate your request. That way, you might be eligible for unemployment if they let you go because of your not relocation OR find a position in your current location. Don't know Florida labor laws but check out the Fla DOL website.
