Will my future employers have access to medical records?
Asked by pal1023
I was recently diagnosed with ADD (it was a late detection) and prior to the diagnosis, I made arrangements to go onto my first job interview. I know the employer can't deny me the job b/c of ADD under the ADA of 1990, but will he have access to my medical records while interviewing me? Does he have a right to know about my ADD? I am under medication and strict observation, if that information helps.

Best Answer:
your medical records are private prior to hiring if the employer provides insurance for employees at some point in time they may have limited access to some medical information (which must be strictly guarded). since you have brought up ADA it is important to realize that protection is afforded only if the employer is aware of your condition and you have asked for a "reasonable accommodation"............. you can not hide a medical condition from your employer and then when that condition causes you to NOT perform as required claim protections because of that condition....... if you can perform the essential functions of the job there is no reason to bring up your condition BUT if you can not perform the essential duties without an accommodation or after you are hired find you can not meet the employers needs without an accommodation then you need to explain your condition, provide medical documentation and ask for an accommodation that works for your needs and allows you to perform the job......... see: http://www.dol.gov/dol/topic/disability/ada.htm http://www.ada.gov/ http://www.eeoc.gov/types/ada.html http://www.eeoc.gov/
