TITLE: DIR - GOVT CONTRACTS & COMPLIANCE - Princeton, NJ

Job Description
This position will provide strategic recommendations to Senior Management in all areas of both Federal and State level activities. The person will oversee and lead an analytical team in the development and implementation of processes and programs to ensure that NNI government price submissions are compliant with all Federal and State regulations. This position requires the ability to proactively adjust activities of the organization as it relates to government pricing and compliance from both a systems and activity perspective. Ensures timely and accurate filing of all government reports to avoid monetary penalties assessed by any government agency for late or inaccurate reporting. Manage the Medicaid Drug Rebate Program, Dispute Resolution Process, FSS contracting and PHS/340B pricing/reporting. Analyzes, interpret and recommend actions to improve the business, based on segment strategy. Maintains up-to-date knowledge around Federal and State Compliance regulations and interprets their financial impact to NNI. Co-develops pricing strategy for all government channels. Develops budgets and forecasts for all government accounts including but not limited to VA/DOD and state Medicaid programs. Directs efforts to ensure that Novo Nordisk policies and procedures related to federal and state pricing requirements are fully compliant and reported timely to Federal and Stare price reporting programs including but not limited to: the Medicaid Drug Rebate Program, Federal Supply Schedule, Medicare ASP, PHS/340B and State pricing reporting programs.

RELATIONSHIPS:

Two direct reports Sr. Manager, Government Contracts and Compliance and Manager of Government Contracts and Compliance - Federal. Reports to the Sr. Director, Pricing, Contract Operations and Reimbursement. Works closely with Director, Strategic Pricing; Pricing Analysts, Director, Contract Operations; Director, Customer Segment Marketing, Government; Field based Account Executives; Director, Health Economics; Brand Teams; BioPharmaceuticals Marketing; Legal, Compliance and Finance. Develop recommendations for Pricing Committee on Government Pricing related proposals. External relationships include professional associations, vendors, government agencies and other customers.


ESSENTIAL FUNCTIONS:
·Government Programs Compliance
·Oversees the strategic development and implementation of processes and programs to ensure that NNI government price submissions are compliant with all Federal and State regulations.
·Responsible for all vendor oversight, systems implementation and accuracy
·Will lead 5-7 year system and capability plan.
·Leads all research and evaluation of new legislation and is charged with development of new strategies and processes/systems for continued compliance.
·Leads the evaluation of any new system implementation and testing as it relates to Government Pricing and Compliance
·Responsible for ensuring compliance in Medicaid rebate and Federal and State pricing programs.
·Responsible for maintaining ongoing communication with Finance, Sales and Marketing and Legal to monitor and analyze price affecting arrangements which may require consideration for Government price reporting calculations.
·Oversees and manages the operation of the Government Pricing System, keeping all business rules up-to-date to insure accurate calculation of Government Pricing and maintenance insuring full compliance with Government Pricing regulations.
·Responsible for the accuracy in forecasting and financial accruals needed for financial budgets and earning projection objectives.
·Responsible for overall management and quality control of consultants and external vendors.
·Regularly interact with business functions outside of Government Pricing & Compliance (including but not limited to: Compliance, Legal, Finance, IT) regarding business processes and systems which may impact Government price reporting calculations, systems, and/or processes.
·Work closely with the Legal department and Outside Counsel regarding policy and methodology matters related to state and Federal programs.
·Responsible for overseeing any assessment, internal compliance audit, recalculation, voluntary disclosure, or request for information.
·Ensures that NNI avoids the penalties associated with inaccurate or non-compliant filings ($10,000 per line item per day).
·Develops an understanding of the market place and changes that may impact government price reporting through interaction with vendors, Account Executives and research of the government websites and publications and communicates them to key stakeholders. Makes recommendations to Senior Management to address these changes.
·Manages Team and owns the communication as it relates to the development of internal reports/controls for all government price points.
·Provides leadership, guidance and expertise on government pricing issues to all levels of the organization.
·Regularly reports and makes recommendations to the Pricing Committee, Legal and Finance regarding findings, concerns and performance with regard to compliance issues.
·Is responsible for the final accuracy and submission of monthly and quarterly development price calculations (AMP, Best Price, ASP, Non-FAMP, 340B, IFF) in the Government Pricing System.
·Maintains relationships with and reports prices to the various government agencies working closely with Contract Operations to ensure all price submissions are timely and accurate.
·Assists in the negotiation of contracts with Federal and State Government Agencies and their Pharmacy Benefit Managers.

·Medicaid
·Manages all processes related to the quarterly pricing calculations to include AMP, BP, RPU, URA and CPI_U Penalty utilizing the GP system and ensures timely reporting to CMS.
·Maintains the role of Administrator Subject Matter Expert on the Model N Medicaid and GP Systems.
·Responsible for the accurate processing of Federal and State Medicaid rebate invoices to ensure:
Accuracy of payments
Timeliness of payments
Accurate interest payment calculations, if applicable
·Oversees the Dispute Resolution process, tracks the recovery efforts, provides progress reports and attends DRP meetings as needed

·Federal Supply Schedule
·Performs the monthly AMP, quarterly and annual pricing calculations to include AMP, NFAMP, FCP, and OGA pricing utilizing the GP System.
·Maintains the role of Subject Matter Expert on the GP System.
·Manages the administration of the Federal Supply Schedule contract to include BPAs and our existing National Contract.
·Ensures timely payments and reporting to the VA; these include IFF and the Report of Contractor Sales
·Ensures the Subcontracting Plan is managed in accordance with the FAR and reports are submitted as required



Public Health Service/340B
·Responsible for the quarterly PHS pricing calculation utilizing the IMany GP System and ensures timely and accurate reporting to HRSA's Office of Pharmacy Affairs.

·Pricing Strategies Government Accounts
·Assists in the development of the VA/DOD, FSS, 340B and Medicare contract pricing strategies. Makes recommendations for Government Segment Pricing Guidelines to the Pricing Committee.

·Budget and Forecasting
·Oversees and approves budgets/forecast for government contracts.
·Manages the quarterly reporting process comparing actual results to forecasts.

KEY SUCCESS FACTORS: EDUCATION, EXPERIENCE, KNOWLEDGE AND SKILLS

·Bachelor's degree required. MBA preferred.
·10 years experience in pricing, forecasting, contracting, sales analysis, finance and reporting experience or other related experience within the pharmaceutical industry required
·At least 3 years management experience required.
·Excellent communication and negotiation skills
·Experience in the development and use of pricing models.
·Strong analytical, quantitative, and qualitative analysis skills required.
·Excellent PC skills required.
Experience with Government Pricing Systems (e.g. iMany or Model N).
·Working understanding of government programs and regulations associated with these programs.
·Knowledge and understanding of Sarbanes-Oxley controls / processes and their application to the business.
·Good knowledge of process controls.
OTHER:
·Approximately 20% overnight travel
