Description Prescription Solutions is one of the largest pharmacy benefit managers in the United States and has been recognized nationally for its innovative clinical programs studying the efficacy, quality and safety of drugs. It provides retail pharmacy network claims processing; mail order pharmaceuticals; specialty pharmaceutical management; retail network contracting; rebate contracting; and clinical programs such as formulary management and disease/drug therapy management. Prescription Solutions also provides distribution services for specialized medial supplies, over-the-counter drugs, vitamins, minerals and supplements. A UnitedHealth Group company, Prescription Solutions is part of UnitedHealth's Enterprise Services Group.
This position is the senior legal position for Prescription Solutions; serves on the senior business team for Prescription Solutions and the senior legal team for Enterprise Services. This position reports to the General Counsel, Enterprise Services with a dotted line to the CEO, Prescription Solutions.
Responsibilities Include:
- Provide Prescription Solutions' senior management with effective advice and counsel on key legal issues (including complex regulatory and transactional matters) and business strategies.
- Deploy, manage and develop Prescription Solutions' legal staff and outside counsel (as required) to provide efficient and effective legal services for Prescription Solutions.
- Coordinate effectively on cross-cutting issues with lawyers and business leaders in other parts of Enterprise Services and UnitedHealth Group and contribute to effective legal and risk management across the organization.
- Advise Prescription Solutions' regulatory affairs, compliance and privacy teams on specific questions as well as general policies and procedures, coordinating with related Enterprise Services and UnitedHealth Group functions.
- Develop, maintain and enhance expertise related to all aspects of regulation of pharmacy benefits management.
- Negotiate, draft and review general commercial and services agreements including: drug manufacturer agreements, pharmacy network contracts, computer software, hardware and outsource agreements.
- Quickly gain an understanding of the business and the goals and objectives of the senior.
- Prescription Solutions team and direct and manage the legal functions in a manner that will assist Prescription Solutions in meeting these objectives.
Qualifications
- 10+ years practicing healthcare law
- Desirable focus areas include: Medicare Part D program requirements (including requirements for stand-alone prescription drug plans, any plans associated with Medicare Advantage plans, employer group waiver plans, and the retiree drug subsidy program); Part D issues (for example, mail order, marketing, rebates/price concession reporting, low-income subsidy and compliance plan-related matters); ERISA; Medicaid laws; fraud and abuse; privacy and security; antitrust and trade regulations; state insurance requirements; investigations and subpoenas; commercial contracting
- Relevant industry, nationally recognized law firm and/or government agency experience
- Excellent written and verbal communication skills
- Proven strategic decision-making ability and analytical skills
- Integrity and a strong ethical center
- Ability to work effectively on multiple projects at the same time
- Responsiveness, adaptability and collegiality
- Tested ability to work effectively across a large organization
